There would be the full set of chromosomal dna in the nucleus of each osteon (bone cell) including the set which determines gender as well as the mitochondrial dna in the mitochondria. The reason mitochondrial dna was specifically mentioned is because it is useful in determining relationships, in this case the relationship between the deceased (ashes) and the murderer (saliva). It sound like it would be tricky to run the analysis though, because the sample size is small and the saliva was mixed with the ash. The ashes would not have dna in them because the cells are destroyed; if it weren't for the bone fragment they would have had nothing.
